1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, or using the Safe Vault: Hide Photos mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Preyashkumar Gaudani ("Developer", "I", "me", or "my"), an individual developer based in India.

2. DESCRIPTION OF SERVICE

Safe Vault: Hide Photos is a mobile application that provides users with:

Secure storage for photos and videos
Password-protected access to hidden media files
Encryption capabilities for stored content
Additional privacy features as may be offered from time to time

3. ELIGIBILITY AND GLOBAL AVAILABILITY

3.1 Age Requirements

You must be at least 13 years of age (or the minimum age required in your country) to use this App. By using the App, you represent and warrant that:

You meet the minimum age requirement in your jurisdiction
You have the legal capacity to enter into this agreement
You will use the App in compliance with all applicable laws in your country

3.2 Geographic Availability

This App is available globally. However, you are responsible for ensuring that your use of the App complies with local laws and regulations in your country of residence.

4. USER ACCOUNT AND SECURITY

4.1 Account Creation

To use certain features of the App, you may need to create an account. You agree to:

Provide accurate and complete information
Maintain the security of your password and PIN
Accept responsibility for all activities under your account

4.2 Password Security

You are solely responsible for maintaining the confidentiality of your password, PIN, or any other security credentials used to access your hidden content.

5. USER CONTENT

5.1 Your Content

You retain all rights to the photos, videos, and other content you store in the App ("User Content"). By using the App, you grant me a limited license to:

Store and backup your content locally on your device
Process your content to provide the Service
Display your content back to you within the App

5.2 Prohibited Content

You agree not to store, upload, or share content that:

Violates any laws or regulations in your jurisdiction
Infringes on intellectual property rights
Contains illegal material
Is defamatory, obscene, or offensive
Contains malware or harmful code
Violates the Information Technology Act, 2000 of India or similar laws in your country

6. PRIVACY AND DATA PROTECTION

6.1 Data Collection

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

6.2 Local Storage

The App stores your hidden photos and videos locally on your device. I do not have access to your hidden content unless you explicitly choose to use cloud backup features (if available).

6.3 Security Measures

While I implement industry-standard security measures, no method of electronic storage is 100% secure. You acknowledge that you use the App at your own risk.

6.4 GDPR and International Privacy Laws

For users in the European Union, I comply with GDPR requirements. Users from other regions are protected under applicable local privacy laws.

7. INTELLECTUAL PROPERTY

7.1 App Ownership

The App, including its design, features, and functionality, is owned by me, Preyashkumar Gaudani, and is protected by intellectual property laws of India and international treaties.

7.2 License to Use

I grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. DISCLAIMERS AND LIMITATIONS

8.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 No Guarantee

I do not guarantee that:

The App will be uninterrupted or error-free
Your content will be 100% secure or never lost
The App will meet all your requirements
The App will be compatible with all devices or operating systems

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, I SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. INDEMNIFICATION

You agree to indemnify and hold harmless Preyashkumar Gaudani from any claims, damages, losses, or expenses arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your User Content

10. MODIFICATIONS TO THE APP AND TERMS

10.1 App Updates

I reserve the right to modify, suspend, or discontinue the App at any time without notice. However, I will make reasonable efforts to notify users of significant changes.

10.2 Terms Updates

I may update these Terms from time to time. I will notify you of material changes by posting the new Terms and updating the "Last Updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

11. TERMINATION

11.1 By You

You may stop using the App at any time and delete it from your device.

11.2 By Me

I may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms.

11.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. All provisions that should survive termination shall remain in effect.

12. GOVERNING LAW AND JURISDICTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the Indian Contract Act, 1872, the Information Technology Act, 2000, and other applicable laws.

12.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Surat, Gujarat, India. However, this does not prevent you from bringing claims in your local jurisdiction where required by law.

13. DISPUTE RESOLUTION

Any disputes arising from these Terms or the use of the App shall be resolved through:

Good faith negotiations between the parties
Mediation under the Arbitration and Conciliation Act, 1996 of India
If mediation fails, binding arbitration in accordance with the rules of the Indian Arbitration Association

For users outside India, disputes may be resolved according to applicable local laws while respecting the choice of Indian law for interpretation of these Terms.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms constitute the entire agreement between you and me regarding the App.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in effect.

14.3 Waiver

Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without my written consent.

14.5 International Users

If you are using this App outside of India, you are responsible for compliance with local laws and regulations.

16. ADDITIONAL PROVISIONS FOR INDIAN USERS

16.1 Compliance with Indian Laws

This App complies with:

The Information Technology Act, 2000
The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011
The Consumer Protection Act, 2019
